The Association Is Compelled to Appeal to the State Regulatory Service of Ukraine

As previously reported, the Association has addressed the Ministry for Communities and Territories Development of Ukraine twice with a request to provide information regarding the repeated monitoring of the effectiveness of Order No. 441 of the Ministry of Infrastructure of Ukraine dated June 22, 2022. This Order, effective from June 29, 2022, raised railway freight transportation tariffs for all types of cargo by 1.7 times. However, this central executive authority failed to respond both times to the specific questions posed (for more details, see the “News” section dated January 10, 27, and 31 and February 24, 2025).

Therefore, the Association was compelled to appeal to the State Regulatory Service of Ukraine with a request for the following clarifications:

1. Is the Ministry for Communities and Territories Development of Ukraine required to conduct a repeated monitoring of the effectiveness of Order No. 441 of the Ministry of Infrastructure of Ukraine dated June 22, 2022?

If not, on what legal grounds?

2. What specific liability is borne by the heads of regulatory authorities, their officials, as well as the heads of structural units or other responsible officers of regulatory bodies entrusted with the implementation of regulatory functions, in case of violation of legislative requirements in the field of state regulatory policy, as provided for in Article 41 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Sphere of Economic Activity”?

Should it be confirmed that the Ministry for Communities and Territories Development of Ukraine is indeed required to carry out the repeated monitoring of the effectiveness of Order No. 441 of the Ministry of Infrastructure of Ukraine dated June 22, 2022, the Association has requested the State Regulatory Service of Ukraine to submit the appropriate demand to the Ministry, since both previous appeals by the Association on this matter were left without a proper response.
