The response of the State Regulatory Service of Ukraine

As previously reported (see the information in the News section of March 03, 2025), the Association appealed to the State Regulatory Service of Ukraine to provide clarification on the implementation by the Ministry of Communities and Territories Development of Ukraine of the re-tracking of the Order of the Ministry of Infrastructure of Ukraine dated June 22, 2022 No. 441.

The response letter of the State Regulatory Service of Ukraine dated March 20, 2025 No. 1255/20-25 is attached.

From the Association. Thus, the Ministry of Communities and Territories Development of Ukraine completely ignores the requirements of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity” (for more information on this issue, see the News section of January 10, 27 and 31, and February 24, 2025).

The problem with the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity” is that it does not provide for liability for failure to provide a report on the tracking of a regulatory act.

The following is also interesting.

The Ministry of Communities and Territories Development of Ukraine in its Report on Periodic Monitoring of the Effectiveness of the Order of the Ministry of Infrastructure of Ukraine dated December 27, 2017 No. 476 “On Amendments to the Coefficients Applicable to the Tariffs of the Collection of Tariffs for the Transportation of Goods by Rail within Ukraine and Related Services” stated that no studies of the performance indicators of this regulatory act were conducted, since the Coefficients applicable to the tariffs of the Collection of Tariffs for the Transportation of Goods by Rail within Ukraine and Related Services approved by Order No. 476 became invalid when Order of the Ministry of Infrastructure of Ukraine No. 205 “On Amendments to the Coefficients Applicable to the Tariffs of the Collection of Tariffs for the Transportation of Goods by Rail within Ukraine and Related Services” dated March 22, 2019, which approved new coefficients, came into force.

And the study of the performance indicators of the Order of the Ministry of Infrastructure of Ukraine No. 205 of March 22, 2019 was also not conducted, since the Coefficients applicable to the tariffs of the Collection of Tariffs for the Transportation of Goods by Rail within Ukraine and Related Services approved by Order No. 205 became invalid when the Order of the Ministry of Infrastructure of Ukraine No. 418 of August 11, 2021 “On Amendments to the Coefficients Applicable to the Tariffs of the Collection of Tariffs for the Transportation of Goods by Rail” came into force.

Consequently, the Ministry of Communities and Territories Development of Ukraine decided not to re-track the Order of the Ministry of Infrastructure of Ukraine No. 441 dated June 22, 2022, while delaying the final decision on the issue of raising freight tariffs by 37 percent this year, as announced last year.
