{"id":3422,"date":"2025-03-07T16:10:20","date_gmt":"2025-03-07T14:10:20","guid":{"rendered":"https:\/\/avnbmu.com.ua\/?p=3422"},"modified":"2025-06-05T16:12:05","modified_gmt":"2025-06-05T13:12:05","slug":"legal-position-of-the-supreme-court","status":"publish","type":"post","link":"https:\/\/avnbmu.com.ua\/en\/news\/legal-position-of-the-supreme-court\/","title":{"rendered":"Legal Position of the Supreme Court"},"content":{"rendered":"\n<p>An inspection report is not sufficient evidence of a violation of environmental legislation \u2014 this is the legal position of the Supreme Court.<\/p>\n\n\n\n<p>To recover damages caused by a violation of environmental legislation, it is necessary to prove the presence of all elements of a legal offense: unlawful conduct, fault, the existence of damage, and a causal link.<\/p>\n\n\n\n<p>An inspection report issued by an authorized body cannot serve as the sole and sufficient proof of a violation; it must be assessed by the court in conjunction with other evidence.
