The Association has expressed its opposition to the proposed version of the draft resolution of the Cabinet of Ministers of Ukraine “On Amending the Resolution of the Cabinet of Ministers of Ukraine dated March 13, 2022, No. 303”<\/em>, which was developed by the State Environmental Inspectorate of Ukraine<\/strong>. The draft provides for the resumption of scheduled and unscheduled state supervision (control) measures in the field of environmental protection, rational use, reproduction, and conservation of natural resources in accordance with the procedure established by the Law of Ukraine “On the Basic Principles of State Supervision (Control) in the Field of Economic Activity”<\/em>, in areas of Ukraine where hostilities are not taking place, without prior approval from the Ministry of Environmental Protection and Natural Resources of Ukraine<\/strong>.<\/p>\n\n\n\n

The Association\u2019s position is based, in particular, on the following grounds:<\/p>\n\n\n\n

  1. The absence of this draft resolution<\/strong> from the 2025 Activity Plan for the Preparation of Draft Regulatory Acts of the State Environmental Inspectorate of Ukraine, approved by Order No. 179 of the State Environmental Inspectorate of Ukraine dated December 13, 2024. This constitutes a violation of one of the principles of state regulatory policy, set out in Article 4 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity”<\/em>, namely: predictability<\/strong> \u2014 the consistency of regulatory activity, its alignment with state policy objectives and planning, which enables economic operators to plan their activities accordingly.<\/li>\n\n\n\n
  2. The mentioned draft resolution was also not included in the approved 2025 Activity Plan<\/strong> for the preparation of draft regulatory acts of the State Environmental Inspectorate of Ukraine within the deadline established by Part Four of Article 7<\/strong> of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity.”<\/em><\/li>\n\n\n\n
  3. Discrepancies<\/strong> between the number of business entities subject to regulation under the draft resolution and the number of entities listed in the 2025 State Supervision (Control) Plan<\/strong> of the State Environmental Inspectorate of Ukraine, approved by Order No. 151 dated November 28, 2024.<\/li>\n<\/ol>\n\n\n\n

    In addition, during his speech at the “Government and Business: From Dialogue to Partnership”<\/strong> forum held on June 27, 2025, in Kyiv, President of Ukraine Volodymyr Zelenskyy<\/strong> announced that he had already instructed the introduction of a long-term moratorium on business inspections.<\/p>\n\n\n\n

    \u201cI have already instructed the preparation of a decision regarding a long-term moratorium on business inspections \u2014 to protect businesses from any pressure by unscrupulous individuals in various positions,\u201d
    \u2013 said the Head of State.

    In light of this, the Association considers it appropriate to await the decision of the Cabinet of Ministers of Ukraine<\/strong> based on the President’s instruction and to assess its specific content once adopted.<\/p>\n\n\n\n

    At the same time, the Association has submitted a formal request to the State Regulatory Service of Ukraine<\/strong>, asking it to refuse approval of the draft resolution<\/strong> of the Cabinet of Ministers of Ukraine.<\/p>\n\n\n\n
