{"id":4095,"date":"2025-10-28T17:54:28","date_gmt":"2025-10-28T15:54:28","guid":{"rendered":"https:\/\/avnbmu.com.ua\/?p=4095"},"modified":"2025-10-29T17:58:43","modified_gmt":"2025-10-29T15:58:43","slug":"status-of-the-railway-transport-market-reform-in-ukraine-2","status":"publish","type":"post","link":"https:\/\/avnbmu.com.ua\/en\/news\/status-of-the-railway-transport-market-reform-in-ukraine-2\/","title":{"rendered":"Status of the Railway Transport Market Reform in Ukraine"},"content":{"rendered":"\n<p>Exactly one year ago, in October 2024, the Cabinet of Ministers of Ukraine submitted to the Verkhovna Rada a draft law titled \u201cOn the System and Specifics of Functioning of the Railway Transport Market of Ukraine\u201d (Reg. No. 12142 of October 21, 2024).<\/p>\n\n\n\n<p>This draft law aims to align Ukraine\u2019s legislation with that of the European Union in the field of railway transport and introduces a new market model similar to those used in European railway systems.<\/p>\n\n\n\n<p>The draft law provides for the creation of:<\/p>\n\n\n\n<ul>\n<li>a central executive authority responsible for implementing state policy in the field of railway transport;<\/li>\n\n\n\n<li>a National Commission for State Regulation in the Transport Sector, which would oversee tariff and pricing policy;<\/li>\n\n\n\n<li>a National Bureau for the Investigation of Transport Accidents.<\/li>\n<\/ul>\n\n\n\n<p>The establishment of these institutions would require additional state budget funding.<br>Once enacted, the law would repeal the existing Law of Ukraine \u201cOn Railway Transport.\u201d<\/p>\n\n\n\n<p>Importantly, the law is set to enter into force five years after the termination or cancellation of martial law in Ukraine, except for certain provisions that would take effect the day after its official publication.<\/p>\n\n\n\n<p>According to Article 93 of the Law \u201cOn the Rules of Procedure of the Verkhovna Rada of Ukraine,\u201d the Committee on Transport and Infrastructure was designated as the lead committee responsible for preparing and reviewing the draft law. The Budget Committee, the Anti-Corruption Policy Committee, and the Committee on Ukraine\u2019s Integration into the European Union were required to provide expert opinions.<\/p>\n\n\n\n<p>Current progress:<\/p>\n\n\n\n<ul>\n<li>The Anti-Corruption Policy Committee has not provided its expert opinion within the past year.<\/li>\n\n\n\n<li>The Budget Committee, in its conclusion dated March 27, 2025, stated that the draft law requires revision to bring it in line with certain provisions of the Constitution of Ukraine and the Budget Code of Ukraine.<\/li>\n\n\n\n<li>On February 12, 2025, Deputy Prime Minister for European and Euro-Atlantic Integration and Minister of Justice Olha Stefanishyna submitted the European Commission\u2019s Opinion assessing the draft law\u2019s compliance with EU law and Ukraine\u2019s international commitments in the area of European integration. The opinion, spanning 133 pages, identified several provisions of the draft that do not conform to EU legal norms or Ukraine\u2019s international obligations.<\/li>\n<\/ul>\n\n\n\n<p>To date, the Committee on Transport and Infrastructure has not yet reviewed the draft law in its first reading.<\/p>\n\n\n\n<p>As a result, there is growing skepticism that the draft law No. 12142 will be submitted for parliamentary consideration within 2025.<\/p>\n\n\n\n<p>This delay, in turn, increases the likelihood that JSC \u201cUkrzaliznytsia\u201d will receive approval to raise freight transportation tariffs later in 2025.<\/p>\n\n\n\n<p><em>Photo source: www.freepik.com<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Exactly one year ago, in October 2024, the Cabinet of Ministers of Ukraine submitted to the Verkhovna Rada a draft law titled \u201cOn the System and Specifics of Functioning of the Railway Transport Market of Ukraine\u201d (Reg.
