Cabinet of Ministers Approves Implementation Plan for NSDC Decision
By its Decision of July 21, 2025, “On the Introduction of Legal and Organizational Measures for the Moratorium on Unjustified Inspections and State Interference in Business Activities and for Stimulating Economic Growth in Ukraine” (enacted by Presidential Decree No. 538/2025 dated July 21, 2025), the National Security and Defense Council of Ukraine (NSDC) recommended that the Verkhovna Rada of Ukraine expedite consideration of a number of draft laws, including the Draft Law of Ukraine “On the Basic Principles of State Supervision (Control)” (Reg. No. 5837 of August 5, 2021).
This draft law was developed to improve the principles of state supervision (control), to unify the procedure for conducting supervisory measures, and to eliminate inefficient and burdensome provisions of the current Law of Ukraine “On the Basic Principles of State Supervision (Control) in the Sphere of Economic Activity”. Specifically, the draft law:
- was submitted by the Cabinet of Ministers of Ukraine;
- is intended to replace the current law on state supervision (control) in the sphere of economic activity;
- was adopted in the first reading by the Verkhovna Rada on October 8, 2024;
- is set to enter into force six months after its official publication.
The Main Scientific and Expert Department of the Verkhovna Rada Administration raised several comments on the draft law. These pertained to its title and scope, terminology, the list of core principles of state supervision (control), the grounds for conducting unscheduled inspections, and the proposed amendments to the Code of Administrative Procedure of Ukraine and the Law of Ukraine “On Licensing of Types of Economic Activities”, among others.
The Verkhovna Rada Committee on Economic Development, designated as the lead committee for consideration of the draft law, was scheduled to review the document in its second reading on July 23, 2025. However, following discussions, the Committee decided to postpone its consideration to a later meeting.
