In the central legislative and executive bodies
● At the plenary session on 22 August 2024, the Verkhovna Rada of Ukraine adopted the Law of Ukraine ‘On Amendments to the Customs Code of Ukraine on the Implementation of Certain Provisions of the Customs Code of the European Union’ (Reg. No. 10411 of 16 January 2024).
The adoption of this draft law was one of Ukraine’s obligations under agreements with the International Monetary Fund, the World Bank and the European Union.
The law introduces the concept of customs representation similar to that of the EU, as well as the European approach to consolidate provisions on customs regimes.
In addition, the Law brings the provisions of the Customs Code of Ukraine on delivery, presentation of goods and their temporary storage under customs control in line with the EU Regulations.
Also, the Ukrainian Customs Code will now introduce new terms and bring the existing terminology in line with the terminology of European legislation.
● The MP O.M. Yurchenko submitted to the Verkhovna Rada of Ukraine the Draft Law ‘On Amendments to the Commercial Code of Ukraine on Enshrining the Definition of the Term “Production” at the Legislative Level’ (Reg. No. 11501 of 19 August 2024).
The purpose of this draft law is to consolidate the definition of the term ‘production’ at the legislative level for the practical and effective application of legislative acts, and to prevent errors and avoid difficulties in clarifying disputes related to its application in legal provisions.
The draft law proposes to amend Article 3 of the Commercial Code of Ukraine and define the term ‘production’ as activities related to the creation of final products, including all stages of the technological process, as well as the sale of own products.
● On 19 August 2024, the Ukrainian Geological Survey published on its official website a draft resolution of the Cabinet of Ministers of Ukraine ‘On Amendments to the Methodology for Determining the Initial Sale Price at an Auction (Electronic Bidding) for a Special Permit for Subsoil Use’.
The draft act provides for amendments to the aforementioned Methodology, which, in particular:
- clarify what information should be provided by the State Tax Service of Ukraine and the State Commission of Ukraine for Mineral Resources for processing by the working group established by the Ukrainian Geological Survey;
- equality of conditions for access to subsoil use was ensured, and the calculation of the initial sale price of special permits for subsoil use was made more fair.
