The Association is Compelled to Once Again Address the State Regulatory Service of Ukraine

As previously reported (see the “News” section dated July 22, 2025), the Association addressed the State Regulatory Service of Ukraine (SRS) with a request to provide information on the results of the follow-up monitoring of the effectiveness of Order No. 441 of the Ministry of Infrastructure of Ukraine, dated June 22, 2022, “On Amendments to the Coefficients Applied to Tariffs of the Tariff Schedule for Freight Transportation by Rail within Ukraine and Related Services,” in accordance with SRS letter No. 1882/20-25 of April 29, 2025.

In response, the State Regulatory Service of Ukraine informed that “by letter No. 3133/20-25 dated July 10, 2025, the SRS addressed the Ministry for Communities and Territories Development of Ukraine, requesting that a report on the follow-up monitoring of the effectiveness of the above-mentioned regulatory act be submitted to the SRS within the shortest possible timeframe in accordance with Article 26 of the Law on Regulatory Policy. Upon receipt of the report, the SRS will analyze it for compliance with the requirements of the Law of Ukraine ‘On the Principles of State Regulatory Policy in the Sphere of Economic Activity.’”

Given that two months have passed since the registration of SRS letter No. 3133/20-25 of July 10, 2025, sent to the Ministry for Communities and Territories Development of Ukraine—which is a sufficient period for the preparation of the above-mentioned report—the Association is compelled to once again address the SRS of Ukraine with the following requests:

1. Has the SRS received from the Ministry for Communities and Territories Development of Ukraine the report on the follow-up monitoring of the effectiveness of Order No. 441 of the Ministry of Infrastructure of Ukraine dated June 22, 2022?
2. If such a report has been received, has the SRS conducted its analysis for compliance with the requirements of the Law of Ukraine “On the Principles of State Regulatory Policy in the Sphere of Economic Activity,” and what decision was taken based on the results of such analysis?
3. If such a report has not yet been submitted by the Ministry for Communities and Territories Development of Ukraine, what further steps does the SRS intend to take to resolve this situation and ensure compliance with the requirements of the Law of Ukraine “On the Principles of State Regulatory Policy in the Sphere of Economic Activity”?
