The Association Prepared Supplements and Comments to the Draft Law of Ukraine

The Association prepared additions and comments to the Draft Law of Ukraine “On Amendments to the Law of Ukraine ‘On Permitting System in the Field of Economic Activity’ regarding the protection of the rights of business entities in the field of permitting system” developed by the State Regulatory Service of Ukraine, which concerned

1. Supplementing the draft Law with such a procedure as “amendments” to permitting documents, which is absent both in the current Law of Ukraine “On the Permitting System in the Field of Economic Activity” and in the draft Law developed by the State Regulatory Service of Ukraine.
2. Removal from subparagraph 5 of Section I of the Draft Law of the norm according to which other grounds may be established for leaving an application for obtaining a permit without movement and for refusing to issue a permit.

In the Association’s opinion, such a provision is a corruption component, since it establishes additional grounds, the list of which is already defined in the draft law.

3. Regulation of the frequency of meetings of the Commission for Review of Complaints on the Issues of the Permitting System in the Field of Economic Activity, the establishment of which is provided for by the Draft Law, in order to consider received complaints, appeals, and proposals.
