The Ministry for Communities and Territories Development of Ukraine Continues to Disregard the Requirements of the Regulatory Policy Legislation
The Association recalls that, pursuant to Article 10 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Sphere of Economic Activity”, each regulatory act is subject to a repeated monitoring of its effectiveness. This monitoring must be conducted one year after the act enters into force, but no later than two years from the date it enters into force.
The responsibility for conducting such monitoring lies with the regulatory authority that adopted the respective act.
Furthermore, according to Part Two of Article 26 of the Law “On the Principles of State Regulatory Policy in the Sphere of Economic Activity”, the report on the monitoring of the effectiveness of a regulatory act adopted, inter alia, by a central executive authority must be submitted to the Authorized Body (currently the State Regulatory Service of Ukraine) no later than the business day following the date of publication of such a report.
The Association’s requests to the Ministry for Communities and Territories Development of Ukraine (the “Ministry”) seeking information regarding the repeated monitoring of the effectiveness of Order No. 441 of the Ministry of Infrastructure of Ukraine dated 22 June 2022 — which increased tariffs for all types of freight transportation by rail by a factor of 1.7 effective from 29 June 2022 — have been effectively ignored twice.
Moreover, the Ministry has also twice disregarded official communications from the State Regulatory Service of Ukraine — a central executive authority — requesting compliance with the regulatory policy legislation. Such actions raise concerns regarding adherence to the rule of law.
