Ministry for Communities Development of Ukraine Ignores Regulatory Policy Requirements
As previously reported (see News section, September 16, 2025), the Association appealed to the State Regulatory Service of Ukraine (SRS) regarding the failure of the Ministry for Communities and Territories Development of Ukraine to submit a report on the repeated performance monitoring of Order No. 441 of the Ministry of Infrastructure of Ukraine dated June 22, 2022, “On Amendments to the Coefficients Applied to the Tariffs of the Tariff Guide for Freight Transportation by Rail within Ukraine and Related Services.”
In response, the Association received confirmation that the SRS had officially addressed the Ministry for Communities and Territories Development on July 10 and September 26, 2025, emphasizing the need to comply with the provisions of Article 26 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Sphere of Economic Activity” concerning the monitoring of regulatory act performance. However, as of today, the required monitoring report has not been submitted to the SRS.
The Association reminds that under Article 26 of the aforementioned Law, a performance monitoring report for a regulatory act adopted by a central executive authority must be submitted to the authorized body (i.e., the State Regulatory Service of Ukraine). Based on this report, the SRS evaluates the need to review or revise the respective regulatory act.
