The Association appealed to the relevant committee of the Verkhovna Rada of Ukraine

The Association prepared comments and appealed to the Verkhovna Rada Committee on Environmental Policy and Nature Management with a request to take them into account when finalizing the draft Law of Ukraine “On Mining Waste Management” (Reg. No. 12180 of November 05, 2024) for the second reading in the Verkhovna Rada of Ukraine.

The Association’s comments concerned

• correction of an error in part five of Article 27, as this article does not contain part twelve, which is referred to in part five;
• elimination of duplication of powers of state supervision (control) bodies in the field of environmental protection, rational use, reproduction and protection of natural resources; in the field of geological exploration and rational use of subsoil; in the field of industrial safety, state mining supervision to verify their implementation, compliance with the conditions, requirements and measures specified in the waste management plan, permit for the facility for waste from the extractive industry specified in parts two, three and four of the article
• bringing the amount of fines for violation of the legislation in the field of extractive industry waste management, specified in part three of Article 55, to the amount of fines specified in the articles of the Code of Administrative Offenses of Ukraine on administrative offenses related to the establishment of penalties for administrative offenses in the field of nature protection and use of natural resources, including waste management (for example, Articles 82 and 821), with the use of the tax-free minimum income instead of the minimum wage
